Order
Mr. S.S. Dey, learned Sr. counsel appearing for
the petitioner in the review petition/for respondents in the
CRP made his submission on the point of maintainability of
filing the review petition against the order passed by this
Court in CRP which is filed under Article 227 of the
Constitution of India.
Learned Sr. counsel further advanced his
argument seeking interference of this Court in order passed
and to review the same. Accordingly, he made his
submission on the facts and merits of the case and he relied
upon several Apex Court Judgments.
On the other hand, Mr. S.M. Chakraborty,
learned Sr. counsel assisted by Ms. A. Pal, learned counsel
appearing for the respondents in the review petition
opposed the same. He contended that no review lies against
the CRP. The petitioner ought to have approached the
Supreme Court by way of filing an SLP but not a review
petition before this Court.
