HON'BLE MR.JUSTICE ARINDAM LODH 11.07.2022 Order This is an application filed under Section 173(1) proviso of the Motor Vehicles Act,1988 read with Section 5 of the Limitation Act for condoning the delay of 133 days in preferring the appeal against the judgment and award dated 08.10.2021, passed by learned Member, Motor Accident Claims Tribunal, Court No.5, West Tripura, Agartala in connection with TS(MAC) 93 of 2019.

Heard Mr. A. Das, learned counsel appearing for the applicant-appellant.

Issue notice to the respondents to show cause as to why delay of 133 days in preferring the connected appeal should not be condoned as prayed for; and/or such other or further orders should not be passed, as this Court may deem fit and proper.

Notice is made returnable within 6(six) weeks. Applicant is to take steps for service of notice upon the respondents within 7 days by registered post with A.D. List the matter on 30.08.2022.
