Heard Mr. P. Chakraborty, learned counsel appearing for
the appellants.
The appeal is admitted for hearing on the following
substantial question of law:-
"i) Whether the judgment and decree of both the Courts below in regard to non-consideration of a document relating to possession of the defendant appellant are perverse?
ii) Whether it is the duty of the 1st Appellate Court to decide the appeal keeping in view the scope and power conferred to it under Section 96 read with Order 41, Rule 31 of the Code of Civil Procedure and due to non-compliance with the requirement of Order 41, Rule 31 the Judgment and decree is unsustainable in law and is perverse?"
