Heard Mr. S. Sarkar, learned senior advocate appearing
along with Ms. P. Chakraborty, learned counsel for the appellant.
Heard Mr. R. Datta, learned P.P representing the State
respondent.
In the course of hearing Mr. S. Sarkar, learned senior
advocate has referred to the paper book where it is pointed out that
MO2 to MO 39(3) relying on which the trial court delivered the
judgment of conviction and sentence of the appellant have not been
made available before this court.
The paper book would show that those documents (MO2 to
MO39) could not be incorporated in the paper book because those were
not available in the LC record.
Mr. R. Datta, learned P.P. also submits that these documents
would be necessary for the purpose of hearing this appeal because all
those documents were exhibited during trial and moreover the trial
court relied on those documents for arriving at the conclusion.
Therefore, call for MO2 to MO39(3) from the trial court.
List the matter on 26.11.2021.
