Heard Mr. K. Nandi, learned counsel appearing for the
applicant.
This is an application under Section 5 of the Limitation Act
for condoning the delay of 197(one hundred and ninety seven)
days. But according to the Stamp Reporter's report the actual
delay is 194(two hundred and two) days in filing the appeal
under Section 54 of the Land Acquisition Act from the judgment
and award dated 12.06.2019 delivered in Misc (LA) 27 of 2014 by
the Land Acquisition Judge, Sepahijala District, Sonamura.
Issue notice calling upon the respondents to show cause as
to why the delay of 194(two hundred and two) days in preferring
the appeal, as stated, shall not be condoned as prayed for;
and/or any other order(s) shall not be passed as to this Court
may deem fit and proper in the circumstances of the case.
Notice is made returnable on 26.11.2021.
Since Mr. K. De, learned Addl. G.A. appears and waives
notice for the respondents No.7 & 8, as such no formal notice
needs be issued on those respondents. However, the applicant
shall take steps for service of notice on the remaining
respondents by registered post with A.D. within a week from
today.
