Heard Mr. T Chakraborty, learned counsel appearing for the applicant.

This is an application under Section 5 of the Limitation Act, for condoning the delay of 686 days in preferring the appeal under Section 54 of the Land Acquisition Act, 1894 from the judgment and award dated 23.05.2019 delivered in Misc. (LA) No. 01 of 2016 passed by the Land Acquisition Judge, Court No.3, West Tripura, Agartala.

The delay, however, has been reported to be of 215 days by the Stamp Reporter.

Be that as it may, issue notice calling upon the respondents to show cause as to why the delay of 686 days in preferring the connected appeal from the judgment dated 23.05.2019 shall not be condoned, as prayed for; and/or why such further and other order(s) shall not be passed as to this Court may deem fit and proper in the circumstances of the case.

Notice is made returnable on 29.11.2021. Since Ms. N Chakma Saha, learned counsel appears and waives notice for the respondents No.2, no formal notice is called for in respect of this respondent.

However, the steps for service of notice shall be taken by the applicant on the remaining respondent by registered post with A/D within 08.10.2021.
