Heard Mr. K Nath, learned counsel appearing for the applicant. This is an application under Section 5 of the Limitation Act for condoning the delay of 151 days in preferring the appeal under Section 54 of the Land Acquisition Act, 1894 against the judgment and award dated 24.07.2019 delivered in Misc. (LA) No. 23 of 2014 passed by the Land Acquisition Judge, Sepahijala, Sonamura.

According to the Stamp Reporter, the delay is more than what has been described by the applicant. According to the said report the delay is 253 days.

Be that as it may, issue notice calling upon the respondents to show cause as to why the delay of 151 days in preferring the connected appeal from the judgment dated 24.07.2019 shall not be condoned, as prayed for; and/or why such further and other order(s) shall not be passed as to this Court may deem fit and proper in the circumstances of the case.

Notice is made returnable on 29.11.2021. Since Mr. K De, learned Addl. GA appears and waives notice for the respondents No.19 and 20, no formal notice is called for in respect of those respondents.

However, steps for service of notice shall be taken by the applicant on the remaining respondents by registered post with A/D within 08.10.2021.
