This appeal is filed by State of Tripura challenging the judgment of
the learned Single Judge. Sri Raju Datta for the appellants had completed his
arguments. Sri Somik Deb, who appears for the original petitioner, was
absent. We waited for over 15 minutes for him to arrive. No mentioning was
made on his behalf about his whereabouts or whether we would put up his
gracious presence before or not. We record that the other two Benches were
not in session. After waiting in vacuum for 15 minutes we were conveyed by
one of his colleagues that he has already left the Court.
Ordinarily we would have proceeded to decide the appeal on merits
without the assistance of the counsel for the original petitioner. However, the
judgment relates to the family pension benefits of the old widow whose son Page - 2 of 2
expired in the year 1997. Allowing the appeal without hearing her arguments
would cause great prejudice to her.
With great annoyance but with restrain we refrain from disposing
the appeal just now. We hope learned counsel Sri Deb had a very good
reason for leaving the Court without informing us and for not even having
the matter mentioned before us for adjournment.
List tomorrow(31st March,2021) at 10.30 a.m. peremptorily.
