By means of filing Criminal Revision Petition No.29 of
2021, the petitioner has challenged the judgment and order dated
6/1/2018 of the Judge, Family Court, Agartala whereby
maintenance allowance was denied to the petitioner wife while
granting maintenance allowance of a sum of Rs.15000/- to the
son of the petitioner.
Aggrieved by the said order, the petitioner has filed
the criminal revision petition for granting maintenance allowance
to her also. According to the petitioner, a delay of 708 days has
occurred in filing the criminal revision petition. The petitioner has
therefore, filed this interlocutory application under Section 5 of
the Limitation Act for condonation of said delay in filing the said
criminal revision.
Heard Mr. S. Lodh, learned counsel representing the
Petitioner.
Issue notice to the respondents, returnable on
16.07.2021.
Mr. S. Debnath, learned Addl. P.P has entered
appearance and waived formal service of notice on behalf of the
respondent No.2. It is stated by Mr. Lodh that the petitioner has
already served a copy of the petition along with supporting papers
on Mr. S. Debnath, learned Addl. P.P, therefore, no formal notice
needs to be served on the said respondent.

No.1.
