Heard Ms. A Debbarma, learned counsel appearing for the

petitioner.

This is a petition under Section 12 of the Contempt of Courts

Act, 1971 read with Article 215 of the Constitution of India for drawing

up a contempt proceeding for showing willful disobedience in compliance

of the judgment and order dated 16.03.2021 delivered in WP(C)

No.738/2020. By the said judgment, the respondents were directed to

comply the direction within a period of 3(three) months from the date of

the judgment.

Ms. Debbarma, learned counsel appearing for the petitioner

has categorically stated that the direction of this court has not been

complied as yet and hence, this petition.

Issue notice calling upon the respondents to show cause as

to why a contempt proceeding under Section 12 of the Contempt of

Courts Act, 1971 read with Article 215 of the Constitution of India shall

not be drawn up against the respondents for deliberately violating the

directions as contained in the judgment and order dated 16.03.2021

delivered in WP(C) No.738/2020, as prayed for; and/or any other

order(s) shall not be passed as to this Court may deem fit and proper in

the circumstances of the case.

The notice is made returnable on 16.08.2021.

The steps for service of notice on the respondents be taken

by the petitioner by registered post with A/D within 1(one) week from

today.

It is made absolutely clear that if the reply is not filed by the

respondent by the returnable date, this court may be persuaded to ask

the respondents appear in person and explain why the judgment of this

court has not been complied with.
