Heard Mr. Somik Deb, learned senior counsel assisted by

Ms. R. Chakraborty, learned counsel appearing for the

petitioners.

This is a petition under Section 12 of the Contempt of

Courts Act, 1971 read with Article 215 of the Constitution of India

for initiating contempt proceeding for deliberate violation of the

direction contained in the judgment and order dated 19.02.2021

delivered in WP(C)No.451 of 2020.

Mr. Deb, learned senior counsel has further submitted that

a copy of the judgment was communicated to the District

Magistrate and Collector, Gomati District, Udaipur on 18.06.2021

for compliance of the said direction. This court has directed to

decide the prayer of the petitioners within a period of three

months. Even though the said period has elapsed, the

respondents have not taken any action.

Issue notice calling upon the respondents to show cause as

to why a contempt proceeding under Section 12 of the Contempt

of Courts Act, 1971 read with Article 215 of the Constitution of

India should not be drawn up for purported violation of the order

dated 19.02.2021 delivered in WP(C)No.451 of 2020 as prayed

for; and/or any other order(s) shall not be passed as to this

Court may deem fit and proper in the circumstances of the case.

Notice is made returnable on 24.01.2022.

Steps for service on the respondents be taken by the

petitioner by registered post with A.D. in accordance with rules

within a period of seven days from today.
