Heard Mr. K. Nath, learned counsel appearing for the petitioner. This is a petition under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India for initiating a contempt proceeding for the alleged violation of the judgment and order dated 26.03.2021 delivered in WP(C)No.01 of 2021.
It appears that a copy of the judgment was supplied to the respondents on 04.05.2021. The petitioner has alleged that despite such communication, the direction of this Court has not been complied with and no appeal from the said judgment and order has been preferred so far, as the knowledge of the petitioner goes.
Issue notice calling upon the respondents to show cause as to why a contempt proceeding under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India should not be drawn up for purported disobedience shown to the direction contained in the judgment and order dated 26.03.2021 delivered in WP(C)No.01 of 2020 as prayed for; and/or any other order(s) should not be passed as to this Court may deem fit and proper in the circumstances of the case.
Notice is made returnable on 28.01.2022.
Steps for service of notice on the respondents shall be taken by the petitioner as per rule by registered post with AD within a week from today.
