                                    ORDER

31/08/2021 (Akil Kureshi, CJ)

Learned counsel for the appellant-State submitted that the

application of the petitioner for die-in-harness scheme had to be considered

on the basis of the scheme prevailing at the time of consideration of such

an application and not one which prevailing at the time of death of the

Government servant. In this context, he relied on a three-Judge Bench

judgment of the Supreme Court in case of N.C. Santhosh Vrs. State of

Karnataka and Others reported in (2020) 7 SCC 617. He submitted that as

per the 2019 Scheme, in case of a Government servant who dies after the

age of 50 years, there is a provision for payment of full salary till the date

of retirement inclusive of pension to the family members of the deceased

instead of granting compassionate appointment.
