 ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking

the following relief/s:-

"...to issue Writ of Mandamus or any other appropriate writ or direction declaring the inaction on the part of respondent No.2 in not conducting any investigation or in not taking appropriate action pursuant to F.I.R.No.601/13 against respondent Nos.3 and 4 as arbitrary, illegal and as unjust and issue a consequential direction directing respondent Nos.1 and 2 to forthwith take action and proceed further by conducting investigation and taking appropriate proceedings pursuant to F.I.R No.601/13against respondent Nos.3 and 4..."

2. None appears for the petitioner, Sri D.Pradeep, learned Assistant

Government Pleader for Home appearing for respondent Nos.1 and 2.

3. The learned Assistant Government Pleader for Home, appearing for

respondent Nos.1 and 2, submits that a case in Crime No.601 of 2013 was

registered on the file of Punjagutta Police Station, Hyderabad District. Upon

completion of investigation, a charge sheet was filed; however, the matter was

ultimately treated as civil in nature and closed accordingly. It is therefore

contended that the allegations made by the petitioner do not survive, and

appropriate orders are sought.

4. I have perused the materials on record.

5. The grievance of the petitioner is that respondent No.2 failed to conduct a

proper investigation in Crime No.601 of 2013. However, the final report submitted

by the respondent police indicates that, upon completion of investigation, the

Investigating Officer filed a final report and closed the criminal proceedings,

treating the matter as civil in nature.

6. In view of the above, nothing further survives for adjudication in the present

writ petition. However, liberty is reserved to the petitioner to challenge the final

report before the magistrate, in accordance with law, if advised so.

7. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
