ORDER:
Heard Mr. Sunkara Kalyan Dileep, learned counsel appearing for the
petitioner, Mr. Mahesh Raje, learned Government Pleader for Home appearing
for respondent No.1 and Mr. B.Rajeshwar Reddy, learned Government Pleader
for State of Andhra Pradesh appearing for respondent Nos.2 and 3.
2. The writ petition has been preferred with the following prayer:
"For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly in the nature of a Writ of Mandamus, declaring the action of the Respondents in freezing the Petitioner's bank account bearing Account No. 08521300001762 maintained at DCB Bank, Chandanagar, Hyderabad, as illegal, arbitrary, without authority of law, and violative of the Petitioner's fundamental rights; consequently direct Respondent No.4 to forthwith defreeze and restore full operation of the
Petitioner's bank account; restrain Respondent No.3 or any other authority from in any manner interfering with the operation of the said account; and pass such other or further order or orders as this Hon'ble Court may deem fit and proper in the interests of justice."
3. Learned counsel for the petitioner has referred to the order dated
07.03.2026 passed by the High Court of Andhra Pradesh at Amaravati in
Criminal Petition No.1867 of 2026 whereby the Hon'ble Court has stayed all
further proceedings in F.I.R.No.63 of 2026 on the file of Kalidindi Police
Station, Eluru District till the next date of hearing. The matter has been posted
after eight weeks. The grievance of the petitioner is that in the meantime,
respondent No.3-Station House Officer has freezed the petitioner's Bank
Account in respondent No.4-Bank and paralysed his business operations.
Therefore, he has prayed for declaring the action of the respondents in freezing
the petitioner's bank Account bearing No.08521300001762 maintained at DCB
Bank, Chandanagar, Hyderabad as illegal, arbitrary, without authority of law
and violative of petitioner's fundamental rights.
4. However, learned Government Pleader for State of Andhra Pradesh has
submitted that the cause of action arises in the State of Andhra Pradesh. The
concerned F.I.R is pending before the competent Court of Criminal Jurisdiction
in Eluru District in the State of Andhra Pradesh and petitioner has also got an
interim protection from the High Court of Andhra Pradesh in Criminal Petition
No.1867 of 2026. Merely because respondent No.4-Bank falls in the
jurisdiction of the State of Telangana, the writ petition should not be entertained.
5. In the aforesaid facts and circumstances, after some arguments, learned
counsel for the petitioner seeks permission of this Court to withdraw this writ
petition in order to approach the jurisdictional Court for relief.
6. Liberty, as prayed for, is allowed.
7. Writ Petition is, accordingly, dismissed as withdrawn with the aforesaid
liberty. There shall be no order as to costs.
Miscellaneous applications pending, if any, shall stand closed.
