ORDER:
This Writ Petition is filed with the following relief:
"...to grant appropriate relief more in the nature of writ of mandamus declaring the action of the Respondents No.1 and in insisting to handover and seizing the Innova Vehicle bearing registration No. TS 09EE6226 in connection with FIR No.605/2015, dt. 04.09.2015 on the file of Jubilee Hills Police Station, as arbitrary, illegal, unconstitutional and violating Articles 14, 19(1)(g) and 21 of the Constitution of India and issue consequential directions restraining the respondents from insisting the petitioners to hand over or taking step to seize the Innova Vehicle bearing . registration No. TS 09EE6226, and further direct the respondents Nos.1, 2, 3 and 4 to investigate and enquire and include the names of others who are involved in the crime registered in FIR No. 605/2015, dt. 04.09.2015 on the file of the Jubilee Hills Police Station, and take action according to law including recovering the amount from the accused and repay the same to the 6th respondent, and pass such other order or orders as this Hon'ble High Court deems fit and proper in the circumstances of the case............"
2. Heard Mr.P.V.Krishnaiah, learned counsel for the petitioners and
Mr.D.Pradeep, learned Assistant Government Pleader for Home.
3. Learned counsel for the petitioner submits that respondent No. 1
had insisted on handing over the Innova vehicle bearing No. TS 09 EE
6226 in connection with Crime No. 605 of 2015 of Jubilee Hills Police
Station. Aggrieved thereby, the present petition has been filed seeking
appropriate directions. It is further submitted that this Court, by
interim order dated 08.09.2015, directed the parties to maintain status
quo with regard to possession of the said vehicle, and the said
direction has effectively addressed the grievance of the petitioner.
Hence, it is prayed that appropriate orders be passed.
4. The learned Assistant Government Pleader for Home submits
that, in Crime No. 605 of 2015, after due investigation, a charge sheet
was filed and the same was taken on file as C.C. No. 509 of 2016 on
the file of the learned XVII Additional Chief Metropolitan Magistrate,
Hyderabad. It is further submitted that the proceedings have abated
due to the death of the accused, and accordingly, the case was closed
on 30.09.2025. Thus, nothing further remains for consideration in the
matter, and the petition is liable to be dismissed.
5. I have perused the material available on record.
6. The grievance of the petitioner is that the respondent police
insisted on handing over the subject vehicle in connection with Crime
No. 605 of 2015. However, the developments, as reported by the
learned Assistant Government Pleader, indicate that the investigation
has been completed, a charge sheet has been filed, a calendar case was
registered, and the proceedings have subsequently abated due to the
death of the accused, resulting in closure of the case.
7. In view of the said developments, no further proceedings survive
in the crime, and consequently, the question of seizure or handing over
of the vehicle does not arise. Further, this Court had, by interim order
dated 08.09.2015, directed maintenance of status quo with respect to
possession of the vehicle. A cumulative consideration of the above facts
clearly demonstrates that the grievance of the petitioner stands
effectively redressed, and no further orders are required to be passed
in this matter.
8. Accordingly, this writ petition is dismissed as infructuous. There
shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
