Heard Mr. P. Giri Krishna, learned counsel for the petitioner,

and Mr. K. Goutham Kumar Reddy, learned Assistant Government

Pleader for Mines and Geology, appearing for respondents.

2. Learned counsel for the petitioner submitted that in similar

circumstances this Court disposed of W.P. No.9239 of 2025 by the

order dated 02.07.2025 which was filed by the petitioner in

connection with another quarry site.

3. Learned Assistant Government Pleader for Mines and

Geology submitted that quarry lease of the petitioner over the land

admeasuring Acs.3-00 hectares in Survey No.189 of Kachapur

Village, Shankarpatnam Mandal, Karimnagar District, has been

determined/cancelled by respondent No.2 vide proceedings

No.2925875/R1-3/2025 dated 21.09.2025. Further, the petitioner

has alternate remedy of fling appeal under Rule 35 and revision

under Rule 35-A of the Telangana Minor Mineral Concession

Rules 1966 (for short 'TMMS Rules 1966').

4. However, learned Assistant Government Pleader does not

dispute the fact that same contention was raised by the petitioner in

W.P. No.9239 of 2025, wherein, the writ petition was disposed of

setting aside impugned demand notice therein, and the petitioner

was directed to submit explanation to the show-cause notice therein

within a period of one (1) week from the date of receipt of a copy

of that order.

5. In view of the above, the writ petition is allowed in part

setting aside the impugned demand notice No.4220/Q1/2009 dated

14.11.2024. Further, the petitioner is directed to submit

explanation to the show-cause notice No.5067/Q1/2009 dated

14.10.2024 within a period of one (1) week from the date of receipt

of a copy of this order. On receipt of such explanation, respondent

No.4 shall consider the same and pass orders within a period of two

(2) weeks thereof, by affording opportunity of hearing to the

petitioner. If the petitioner fails to submit explanation within one

(1) week, respondent No.4 is at liberty to take action against the

petitioner strictly in accordance with law. Petitioner is also at

liberty to raise all the contentions and grounds which it has raised

in the present writ petition before respondent No.4 and it is for

respondent No.4 to consider the same. Subject to the result of the

enquiry, respondent No.4 shall issue permits to the petitioner.

There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any,

pending in the writ petition stand closed.
