ORDER:
The present Writ Petition is filed under Article 226 of Constitution of India for the following relief/s:-
''... to issue a Writ of Mandamus or any other appropriate writ, order or direction in the nature of Writ of Mandamus declaring the action of the respondent in not discharging the statutory functions obligated under Section 173, 175 of BNSS and taking necessary action on the Complaint dated 29.04.2024 made by the petitioner as illegal, arbitrary and violative of the law laid down by the Hon'ble Supreme Court of India in Lalita Kumari vs. State of Uttar Pradesh consequently direct the respondent herein to forthwith register FIR basing on the complaint of the petitioner dated 29.04.2024 and pass such other and further order(s) ..."
2. Heard Mr.Vishal Kumar Jain, learned counsel for the
petitioner and Mr.M.Srinivas, learned Assistant Government
Pleader for Home representing learned Government Pleader
for Home appearing for respondents. Perused the record.
3. When the matter is taken up for consideration, learned
counsel for the petitioner seeks a direction to respondent No.2
to take appropriate action on the complaint dated 29.04.2024
submitted by the petitioner and to pass appropriate orders.
4. Learned Assistant Government Pleader for Home, by
filing the copy of written instructions dated 20.02.2026
addressed by the Sub-Inspector of Police, Amberpet Police
Station, Hyderabad Commissionerate contends that as per
record, the petitioner had filed the complaint on 24.09.2024.
Pursuant thereto, respondent No.2 called both the parties and
upon enquiry, he came to know that the petitioner has
pledged the gold ornaments with Jain Jewellers & Pawn
Brokers, Hyderabad during the year 2011 to 2017 and
received the amount. When the petitioner did not redeem the
pledged gold ornaments, within the stipulated period, the
pawn broker sold the same to third parties. The petitioner had
issued legal notice to the pawn broker on 18.04.2024 and as
such there were civil disputes between the petitioner and the
pawn broker. In view of the same, the complaint filed by the
petitioner was closed as 'civil-in-nature' on 21.12.2024 by
directing him to approach the competent Court to redress his
grievance. Stating so, he seeks to dismiss the Writ Petition.
5. Recording the submissions of learned Assistant
Government Pleader for Home and upon taking the copy of
written instructions dated 20.02.2026 onto the file, this Writ
Petition is disposed of by leaving it open to the petitioner to
work out the remedies as available under law.
6. With the above direction, this Writ Petition is disposed
of. No costs.
Miscellaneous Petitions, pending if any, shall stand closed.
