CRIMINAL PETITION No.14777 OF 2024
O R D E R:
This Criminal Petition is filed by the petitioner/A-9,
seeking to quash the proceedings in C.C.No.03 of 2015, on the
file of Special Judicial Magistrate of First Class for Trial of
Cases under Telangana Prohibition and Excise, Karimnagar.
The offences alleged against the petitioner are under Sections
498-A, 506, and 109 of IPC, and Section 4 of D.P.Act.
2. Heard learned counsel for the petitioner and
Sri M.Vivekananda Reddy, learned Assistant Public Prosecutor
for the respondent - State. Perused the record.
3. Learned Public Prosecutor, on instructions, submits that
C.C.No.03 of 2015 was disposed off by the trial Court by
judgment dated 05.02.2018, acquitting A-1, A-3 to A-8, and
A-10. In the copy of the judgment filed by the learned Public
Prosecutor, the trial Court has observed that A-1, A-3 to A-8,
and A-10 were tried for the above said offences. Perusal of the
judgment does not disclose that the Court has either taken
cognizance or that the case was split up against this petitioner.
4. Since the case was neither split up nor any charge sheet
was filed against this petitioner separately. Moreover, since no
proceedings are pending against her, the petition is liable to be
closed.
5. Accordingly, the Criminal Petition is disposed of.
Miscellaneous applications pending, if any, shall stand closed.
