JUDGMENT:

(Per the Hon'ble the Acting Chief Justice Sujoy Paul)

Sri Vijay B.Paropakari, learned counsel appearing for

Sri Bandamidi Swamy, learned counsel for the appellants;

Sri E. Ramesh Chandra Goud, learned Government Pleader for

Land Acquisition, for respondent Nos.1 to 4 and Sri Mahesh Raje,

learned Government Pleader for Home, for respondent No.5.

2. With the consent, finally heard.

3. During the course of hearing, learned counsel for the parties

reached to a consensus. It is agreed that the appellants (writ

petitioners) had prayed in W.P.No.35210 of 2024 for declaring the

action of respondents in dispossessing them as bad in law, but the

same has not been decided by the learned Single Judge. In other

words, it is agreed that since the learned Single Judge has not

decided the question of validity of acquisition qua the appellants

and only decided the question of compensation, the impugned

order passed by the learned Single Judge may be set aside and the

writ petition may be restored for hearing of the matter on the

entire relief.

4. In view of the consensus arrived at, the impugned order

passed by the learned Single Judge in W.P.No.35210 of 2024

dated 03.04.2025 is set aside and the writ petition is restored to

its original number for rehearing.

5. Accordingly, the writ appeal is disposed of without

expressing any opinion on the merits of the case. No order as to

costs.

Miscellaneous petitions pending, if any, shall stand closed.
