WRIT PETITION No.14405 OF 2019
O R D E R:
This Writ Petition is filed, under Article 226 of the
Constitution of India, seeking the following relief:
"...to issue a Writ of Mandamus, or any other appropriate writ, order or direction, seeking to declare the action of Respondents in demanding the Petitioners to pay GST in respect of their respective stalls as mentioned in the cause title and collecting the GST on the monthly license fee from the Petitioners as illegal in violation of Article 14 and 21 of the constitutional and against the principals of natural justice and consequently direct the Respondents to refund the amount of Service Tax/GST collected from the Petitioners from the commencement of the License period of their respective Stalls and pass..."
2. Heard Sri K.Raj Kumar, learned counsel representing
Sri Sandeep Kumar Borla, learned counsel for the petitioners and
Sri P.Satish Kumar, learned Standing Counsel for Telangana State
Road Transport Corporation, for the respondents.
3. When the matter is taken up for hearing, it is noticed that
the issue raised in the present Writ Petition is no longer open for
consideration, as it has already been decided by a Division Bench
of this Court in W.P.No.20885 of 2018, dated 12.12.2022. The
Division Bench examined all relevant contentions, legal arguments
and delivered a reasoned judgment, which is binding on this Court
as well as the parties. Therefore, in view of the aforesaid decision,
the present Writ Petition is not maintainable and is liable to be
dismissed on this ground alone.

4. Accordingly, this Writ Petition is dismissed.
Miscellaneous petitions pending, if any, shall stand closed.
There shall be no order as to costs.
