                WRIT PETITION No.504 OF 2025
ORDER:

With the consent of both the parties, the Writ Petition is

disposed of at the stage of admission itself.

2. This Writ Petition, under Article 226 of the

Constitution of India, is filed seeking the following relief:

"...to declare the action of the Respondents in not considering the case of the petitioner for regularisation of his services as Junior Lecturer in Commerce with effect from 01.11.1990 the date on which the petitioner put in a service of 5 academic years as per G.O.Ms. No.221, Education (C.E.I-2) Dept., dated 20.06.1995 notionally, as illegal, arbitrary, discriminatory, violative of Article 14 and 16 of the Constitution of India by issuing appropriate writ, order or direction more particularly in the nature of Mandamus and consequently direct the Respondents to consider the case of the petitioner for regularisation of his services with effect from 01.11.1990 as per G.O. Ms.No.221, Education (C.E.I-2) Department, dated 20.06.1995 instead of from 30.10.1996 as per G.O.Rt.No.225, Education, (C.E.I) Department for the purpose of pension and pensionary benefits forthwith in terms of order of the Hon'ble Court in Govt. of A.P v. N. Venkaiah and others (2018 Lawsuit (Hyd) 191 and also the Judgment of the Hon'ble Supreme Court rendered in B.Srinivasulu's Case (2021 (13) SCC 460) and further reiterated in SLP (C) No.13813/2018, dated 23.07.2024..."

3. Heard Sri K.Rama Subba Rao, learned counsel for

the petitioner and learned Government Pleader for Services-I,

appearing for the respondents.

4. Learned counsel for the petitioner submits that

the subject matter of this Writ Petition is squarely covered by

the common order passed by this Court in W.P.No.33936 of

2011 and batch, dated 02.05.2018, and requested this Court

to pass similar order in the present Writ Petition also.

5. The same is not seriously disputed by learned

Government Pleader for Services-I.

6. Having regard to the submissions made by learned

counsel for respective parties and for the reasons alike in the

common order, dated 02.05.2018, in W.P.No.33936 of 2011

and batch and in view of the benefit extended by the Hon'ble

Supreme Court in B.Srinivasulu v. Nellore Municipal

Corporation 1, this Writ Petition is disposed of directing the

authorities concerned to reckon the services of the petitioner

from the date of completion of five years in service, on or

before 01.11.1990, for the purpose of his pension and

pensionary benefits. However, he shall not be entitled to

actual monetary benefits for said period in the form of arrears

of pay or allowance. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand

closed.
