                 WRIT PETITION No.2227 of 2025

ORDER:

This Writ Petition is filed praying this Court to declare the

action of respondent authorities in issuing the impugned

endorsement No.B/2807-5/2024, dated 04.09.2024 rejecting

the request made by the petitioner for release of the caretaker

property i.e., land admeasuring Acs.2400.00 guntas in Sy.No.7

situated at Mansoorabad Village, Saroornagar Mandal, Ranga

Reddy District, without conducting proper enquiry and without

affording reasonable opportunity to the petitioners, who are in

occupation of the same as illegal, arbitrary, unconstitutional

and violative of Articles 21 and 300-A of the Constitution of

India and for other appropriate reliefs.

2. Learned counsel for the petitioners submitted that the

petitioners are the plots owners of various extents forming part

of Sy.No.7 situated at Mansoorabad Village, Saroornagar

Mandal, Ranga Reddy District. It is further submitted that the

pattadar of the land Smt.Haneefa Bee, W/o. Burhanuddin kept

the said land under the custody of the Government as care

taker. It is further submitted that the name of the original

pattadar was recorded in all the revenue records, which is

evident from Munthakab and Sethwar No.1262/1352 Fasli,

therefore, he prays to direct the respondents to release the

subject property from the custody of the Government.

3. Considered the submissions of the learned counsel for the

respective parties and with their consent this writ petition is

disposed of at the admission stage.

4. Sri Y.Ranadheer, learned Assistant Government Pleader

for Forest has submitted that earlier some of the plot owners

have filed writ petition and this Court, while disposing of the

W.P.No.26934 of 2018 and batch, relegated the petitioners

therein to approach the competent Court to establish their

rights over the property, but without pursuing the said remedy,

another writ petition also filed vide W.P.No.221 of 2024 before

this Court for release of the property from the alleged custody of

the Government. By an order, dated 01.05.2024 this Court

dismissed the said writ petition and aggrieved by the same

W.A.No.1342 of 2024 was filed and this Court dismissed the

said appeal vide judgment, dated 29.11.2024. The same is not

disputed by the learned counsel for the petitioners.

5. In view of the above submissions and as it is stated by the

learned counsel for the respective parties that the issue raised

in this writ petition is squarely covered by the orders passed by

this Court in W.A.No.1342 of 2024, this Court, following the

said judgment, dismissed this Writ Petition, giving liberty to the

petitioners to go before the appropriate civil Court as directed by

this Court in W.A.No.1342 of 2024, dated 29.11.2024.

6. As a sequel, the miscellaneous petitions pending, if any,

shall stand closed. No costs.
