THE HONOURABLE SMT. JUSTICE K. SUJANA
Tr.Crl.P.No.92 of 2024
ORDER:
This Transfer Criminal Petition is filed by the petitioners to
transfer S.C.No.135 of 2022 in P.R.C.No.6 of 2022 pending on the
file of the learned Senior Civil Judge, Zaheerabad to any other
competent Court in any other district.
2. Heard Sri Mohammed Rafiuddin, learned counsel appearing
on behalf of the petitioners as well as Sri Sunil Anand, learned
counsel appearing on behalf of respondent Nos.2 to 9.
3. Learned counsel for the petitioners submitted that the
petitioners have lost faith in the Court, alleging that the Court's
handling of evidence suggests that it will acquit the accused
despite ample evidence against them. Therefore, they requested
the Court to transfer S.C.No.135 of 2022 to a competent Court in
another District.
4. On the other hand, counsel for the respondents argued that
the allegations against the officer are vague and, as the case is
coming for judgment, there is no need to transfer it. Therefore, he
prayed the Court to dismiss the petition.
SKS,J
5. Considering the submissions made by both the learned
counsel and reviewing the material available on record, it appears
that the transfer petition is filed solely based on the suspicion that
the Court will acquit the accused, without providing any
supporting averments. Therefore, the transfer petition lacks merit
and is liable to be dismissed.
6. Accordingly, this Transfer Criminal Petition is dismissed.
There shall be no order as to costs.
Miscellaneous applications, if any pending, shall stand
closed.
