 1. Maddhi Divakar Reddy and five others.

                                                                        ...respondents.

Mr.Chetluri Sreenivas , learned counsel appearing for the appellants.

Mr.N.Sreedhar Reddy, learned counsel appearing for the respondent Nos.1 to 3.

Mr.Mahesh Raje, the learned Government Pleader for Home appearing for the respondent Nos.4
to 6.

 JUDGMENT:

(Per Hon'ble Justice Moushumi Bhattacharya)

1. The Writ Appeal arises out of an order dated 12.11.2025

passed by a learned Single Judge by disposing of W.P.No.31735

of 2025 filed by the respondent Nos.1 and 2 herein seeking a

direction to the respondent No.3/the Station House Officer,

Medipally Police Station, Medchal-Malkajgii District (the

respondent No.6 herein) to provide police protection for

implementing an order dated 16.06.2021 passed by the II

Additional Junior Civil Judge-cum-II Metropolitan Magistrate, Ranga Reddy District at L.B. Nagar, in I.A.No.71 of 2021 in

O.S.No.461 of 2021.

2. The respondent Nos.1 and 2 herein (the plaintiffs) filed the

Suit for perpetual injunction. The said I.A. was filed for

granting of ad interim injunction to direct the respondent No.3

herein for restraining the plaintiffs in the Suit (respondent

Nos.1 and 2 in the Writ Appeal) from interfering and obstructing

the peaceful possession of the plaintiffs over the petition

schedule properties.

3. The appellants herein, who were the respondent Nos.5 to

7 in the Writ Petition, were named in a

complaint/representation filed by the respondent Nos.1 and

2/writ petitioners before the Station House Officer, Medipally

Police Station, Medchal-Malkajgiri District (the respondent No.3

in the Writ Petition) on 27.09.2025. By the impugned order

dated 12.11.2025, the learned Single Judge disposed of the Writ

Petition granting liberty to the respondent Nos.1 and 2/writ

petitioners to submit a representation before the respondent

No.3/the Station House Officer, Medipally Police Station, along

with the order dated 16.06.2021 passed by the Trial Court in

I.A.No.71 of 2021 in O.S.No.461 of 2021. The learned Single

Judge further directed that on receipt of the representation, the respondent No.3/the Station House Officer, Medipally Police

Station, shall take steps for implementation of the order dated

16.06.2021.

4. The appellants/respondent Nos.5 to 7 are aggrieved by

the impugned order to the extent that the appellants were not

given notice of the impugned direction as such from the Station

House Officer, Medipally Police Station, even though they were

named in the representation dated 27.09.2025.

5. We do not find substance in the grievance raised by the

appellants since the impugned order contains a peremptory

direction on the Station House Officer, Medipally Police Station,

to implement the order dated 16.06.2021 passed by the Trial

Court. Paragraph No.6 of the impugned order does reflects any

direction of giving any notice issued to the parties who may be

affected, by the Station House Officer, Medipally Police Station,

before taking any steps pursuant to the direction contained in

the impugned order.

6. We, hence, deem it fit to direct the respondent No.6/the

Station House Officer, Medipally Police Station, to hear all the

concerned parties including the appellants and the respondent

Nos.1 to 3 before taking any steps for implementing the order dated 16.06.2021 passed by the Trial Court in I.A.No.71 of 2021

in O.S.No.461 of 2021. We are also aware that sufficient

recourse is available to the respondent Nos.1 and 2/writ

petitioners under The Code of Civil Procedure, 1908, for

implementing the order dated 16.06.2021.

7. W.A.No.1383 of 2025, along with all connected

applications, is accordingly disposed of. There shall be no order

as to costs.
