Heard Mr. Nazir Ahmed Khan, learned counsel for the
petitioners, and Mr. G. Madhusudhan Reddy, learned standing
counsel for the GHMC, appearing for respondent No.2.
2. The property of the petitioners bearing H.No.2-4-680/97
admeasuring 27.44 square yards and H.No.2-4-680/100
admeasuring 32.88 square yards respectively total admeasuring
60.32 square yards situated at Sunder Nagar, Harajpeta, Amberpet,
Hyderabad, was acquired for the purpose of 100 feet wide
proposed road from Kachiguda Traffic Police Station to Amberpet
Main road. The preliminary notification was issued under
Section 11 of the Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for
short 'Act 2013') on 10.02.2021 and award was passed in
File No.AA/15/2021 dated 11.08.2021. Petitioner Nos.1 and 2
were paid structural compensation of Rs.2,26,772/- and
Rs.5,65,162/- and land compensation of Rs.21,47,832/- and
Rs.25,73,641/- for their respective property.
3. It is submitted that being unsatisfied with the compensation
amount, the petitioners filed application under Section 64(2) of the
Act 2013 for enhancement of compensation amount in L.A.O.P.
No.349 of 2022 before the learned Land Acquisition,
Rehabilitation and Resettlement Authority for the State of
Telangana, Hyderabad, (for short 'Authority') and the Authority
has passed award on 21.12.2023 enhancing the compensation
amount to Rs.94,100/- from Rs.38,000/- per square yard.
4. It is stated that the petitioners have also filed execution
petition in E.P. No.14 of 2024 for execution of judgment and
decree in L.A.O.P. No.349 of 2022 dated 21.12.2023.
In compliance of the award passed by the Authority, respondent
No.3 issued cheque bearing No.432420 dated 18.09.2025 for a sum
of Rs.88,29,473/- towards enhancement of compensation amount,
in favour of respondent No.4. However, the same has not been
released by respondent No.4 to the petitioners, as such, they are
constrained to approach this Court.
5. Learned standing counsel for the GHMC submitted that the
enhanced compensation amount has been deposited and the
petitioners may be directed to file cheque petition before the
Authority.
6. In view of the above submissions, the writ petition is
disposed of, granting liberty to the petitioners to file cheque
petitions for release of enhanced compensation amount. As and
when such applications are filed, the Authority is directed to
dispose of the same, as expeditiously as possible, preferably within
a period of ten (10) days thereof. There shall be no order as to
costs.
As a sequel thereto, miscellaneous applications, if any,
pending in the writ petition stand closed.
