JUDGMENT:
(Per Hon'ble Sri Justice Abhinand Kumar Shavili)
When the matter is taken up for hearing, learned counsel
appearing for the appellant seeks permission of this Court to
withdraw the writ appeal with liberty to the appellant to
approach the appellate authority i.e., Chief General Manager
under Section 127 of the Electricity Act, 2003.
Reserving such liberty, the Writ Appeal is dismissed as
withdrawn. The Appellate Authority is directed to decide the
appeal based on its own merits without being influenced by the
order passed by the learned Single Judge and other various
authorities. Since the appellant is pursuing its remedies in a
wrong forum, the benefit under Section 14 of the Limitation
Act, 1963, is extended to the appellant. As the appellant has
already deposited 40% of the provisional assessment, balance
10% of the provisional assessment is directed to be deposited by
the appellant to make 50% of the provisional assessment. On
such deposit, the respondents shall restore the electricity
connection to the appellant. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
