             CRIMINAL PETITION No.4662 of 2025

ORDER:

This Criminal Petition is filed under Section 528 of the

Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'the BNSS')

by the petitioner against the order, dated 17.03.2025 passed in

Crl.M.P.No.01 of 2025 in Crl.A.No.22 of 2025 on the file of

learned Special Judge for Fast Tracking the Cases relating to

Atrocities against Women-cum-V Additional District and

Sessions Judge at Khammam. By the impugned order, the

petition filed by the petitioner under Section 430(1) of the BNSS,

was allowed directing the petitioner to deposit 20% of the

compensation amount.

2. Heard Sri Mummaneni Srinivasa Rao, learned counsel

for the petitioner and Sri Arun Kumar Doddla, learned Additional

Public Prosecutor for respondent No.1 - State.

3. Learned counsel for the petitioner submitted that the

petitioner is not financially stable to deposit 20% of the

compensation amount. In this regard, he placed reliance on the

judgment of the Apex Court in Jambu Bandari vs. Madhya

Pradesh State Industrial Development Corporation Limited 1

and prayed the Court to allow the Criminal Petition.

4. Considering the submissions made by the learned

counsel for the petitioner and circumstances of the case, this

Court is inclined to reduce the compensation amount from 20%

to 10% to be deposited by the petitioner.

5. Accordingly, the Criminal Petition is disposed of directing

the petitioner to pay 10% of the compensation amount i.e.,

Rs.1,68,000/-(Rs.16,80,000/- x 10%) within a period of two (02)

months from the date of receipt of copy of this order.

Miscellaneous applications, if any pending, shall also

stand closed.
