JUDGMENT (Per the Hon'ble the Acting Chief Justice Sujoy Paul):

Sri G. Madhusudhan Reddy, learned counsel for the

appellants and Sri D.V.Chalapathi Rao, learned Government

Pleader for Assignment, for the respondents.

2. Learned counsel for the appellants, after arguing for some

time, fairly submitted that the appellants want to avail the remedy

of appeal which is existing as per the findings given by learned

Single Judge in paragraph No.6 of the impugned order dated

03.01.2025. He submits that the appeal may be disposed of by

reserving liberty to the appellants to avail the remedy of appeal and

it may be observed in the interest of justice that the time consumed

before this Court in W.P.No.170 of 2025 and in the present appeal

may not be counted for the purpose of limitation.

3. Learned Government Pleader for Assignment has no

objection to this innocuous prayer.

4. Accordingly, this Writ Appeal is disposed of by reserving

liberty to the appellant to avail the remedy of appeal. In the

interest of justice, it is observed that the time consumed as

aforesaid shall not be counted for the purpose of limitation. No

findings of learned Single Judge will bind the appellate authority

and the appellate authority shall decide the matter on its own

merits in accordance with law. It is made clear that this Court has

not expressed any opinion on merits of the case. No costs.

Interlocutory applications, if any pending, shall also

stand closed.
