JUDGMENT:

(Per Hon'ble Sri Justice P.Sam Koshy)

Heard Mr. Swaroop Oorilla, learned Special Standing Counsel

for the State Tax for the petitioner. Perused the record.

2. Taking into consideration the long efflux of time that has been

passed, the question of law that has been raised by the petitioner/State

in the present tax revision case and the amount of money not being an

issue and the question that is agitated being purely academic, we think

it proper to dispose of the tax revision case at this juncture reserving

the right of the petitioner to raise this ground in some other relevant

matter.

3. The tax revision case, accordingly, stands disposed with the

liberty as stated above. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall

stand closed.
