                      SECOND APPEAL No.48 of 2010

JUDGMENT:

This Second Appeal is filed by the appellant - respondent - plaintiff

against the judgment and decree dated 16.09.2009 passed in A.S.No.22 of 2008

by the Senior Civil Judge, Zaheerabad, Medak District, reversing the judgment

and decree dated 09.10.2006 passed in O.S.No.13 of 2002 by the Junior Civil

Judge, Narayankhed.

2. On 11.08.2023, the learned counsel on record for the appellant reported

that he had given no objection to the clients. Hence, notice was ordered to the

appellant. On 13.09.2023, notice sent to the appellant was returned un-served

on the ground that "no such party was found in the said address". As such, the

matter was directed to be posted on 25.09.2023 under the caption "for

dismissal.

3. As there is no representation even today also and as the appellant is not

evincing any interest in proceeding with the matter, it is considered fit to

dismiss the appeal.

4. Hence, the Second Appeal is dismissed for default. No order as to

costs.

As a sequel, miscellaneous applications pending in this appeal if any,

shall stand closed.
