JUDGMENT:

The present appeal has been directed against the order

and decree dated 17.09.2010 in I.A.No.1005 of 2009 in

O.S.No.221 of 2009 on the file of the Senior Civil Judge,

Khammam.

2. There is no representation for the appellants.

3. This appeal is pertaining to the year 2010. On the last

date of hearing, when the matter was taken up for hearing,

there was no representation for the appellants, and therefore,

the matter was directed to be posted to today under the caption

'for dismissal'. In spite of matter being listed today under the

caption 'for dismissal', there is no representation for the

appellants. This shows that the appellants are not evincing any

interest in prosecuting the case. Therefore, this appeal is liable

to be dismissed for non-prosecution.

4. Accordingly, this appeal is dismissed for

non-prosecution. There shall be no order as to costs.
