                 APPEAL SUIT No.416 of 2008

ORDER:

This Appeal Suit is filed by the appellant, aggrieved by the

Judgment and decree in O.S.No.35 of 1999 dated 19.11.2007

on the file of Agent to Government at Khammam.

2. Learned counsel for the respondent No.1 and 4 present.

Even though the matter is posted for arguments as a last

chance, learned counsel for the appellant was absent today. It

seems that he has no interest to prosecute the case, hence no

purpose would serve in continuing the appeal. Therefore, this

appeal is liable to be dismissed.

3. Accordingly, the appeal suit is dismissed for non-

prosecution.

Pending miscellaneous applications, if any, shall stand closed.
