                    SECOND APPEAL No.1258 of 2009

JUDGMENT:

This Second Appeal is filed by the appellants aggrieved by the judgment and

decree passed in A.S.No.86 of 2007 dated 29.09.2009 by the II Additional Chief

Judge, City Civil Court, Hyderabad, confirming the judgment and decree passed in

O.S.No.5124 of 2003 dated 19.12.2006 by the IX Junior Civil Judge, City Civil

Court, at Hyderabad.

2. When the matter came up for hearing on 25.09.2023, there was no

representation by either counsel. Accordingly, the matter was directed to be

posted to 09.10.2023 under the caption 'for dismissal'. On 09.10.2023, the learned

counsel for the appellants on record was present and requested for an adjournment.

Accordingly, at his request, the matter was directed to be posted to 16.10.2023

under the same caption "dismissal". But, even today also, there is no

representation by the learned counsel for the appellants though the matter is posted

under the caption 'for dismissal'. It appears that the appellants are not interested in

prosecuting the matter.

3. As the appellants are not evincing any interest in proceeding with the

matter, it is considered fit to dismiss the appeal.

4. Hence, the Second Appeal is dismissed for default. No order as to costs.

As a sequel, miscellaneous applications pending in this appeal if any,

shall stand closed.
