2. This intra court appeal has been filed against

an interim order dated 01.09.2023 passed by learned

Single Judge in W.P.No.44165 of 2022, by which learned

Single Judge has directed the respondents in the writ

petition not to interfere with the possession of the writ ::2::

petitioners in respect of the subject property without

following due process of law.

3. Appellant who is not a party in the writ

petition claims title in respect of the land in question on

the strength of a sale deed dated 04.06.2009. The

grievance of the appellant is that he has neither been

impleaded in the writ petition nor has been heard before

passing the impugned order.

4. Appellant appears to be a person vitally

interested in the subject matter of W.P.No.44165 of

2022. The appellant has the remedy of filing an

application seeking intervention as well as vacation of

the ad interim order dated 01.09.2023 passed by learned

Single Judge in W.P.No.44165 of 2022. Needless to

state that in case any such application is filed, the same

shall be dealt with expeditiously.

5. With the aforesaid observation, the Writ

Appeal is disposed of. There shall be no order as to

costs.

Miscellaneous applications, if any pending, shall

stand closed.
