      THE HONOURABLE SRI JUSTICE SAMBASIVA RAO NAIDU

                SECOND APPEAL NO.1170 OF 2017


JUDGMENT :

None appeared for the appellant, though today the

matter was listed under caption 'for dismissal'. On perusal of the

proceeding sheet, it depicts that even on the previous dates of

hearing i.e., on 21.09.2023, 02.11.2023 and 09.11.2023, there

was no representation for the appellant. Since the beginning the

appellant did not evince any interest to proceed with the matter.

Thus, it appears that the appellant is not interested to prosecute

the matter vigilantly and diligently anymore. Therefore, this appeal

is dismissed for non-prosecution.

2. Accordingly, this appeal is dismissed for non-

prosecution.

Pending miscellaneous application, if any, shall stand

closed.
