     CRIMINAL REVISION CASE Nos. 626 and 634 OF 2021
COMMON ORDER:
1.

Since the issue involved in both the Criminal Revision Cases

is one and the same, they are being heard together and disposed

off by way of this Common Order.

2. The wife of accused officer namely K.Padma sold the property

i.e., plot No.469 admeasuring 320 sq.yds to the petitioners 160

sq.yds each.

3. Learned counsel appearing for the petitioners/third parties

would submit that the fact of attachment by the ACB court was not

conveyed to the petitioners herein and having suppressed the said

fact, the property was sold. The ACB authorities did not inform the

Sub-Registrar office regarding the attachment which lead to the

purchase and the petitioners are now suffering having invested

their lifetime savings.

4. Admittedly, the property was subject to attachment. The

disproportion which the accused is facing is Rs.1.90 Crores. It is

not known as to what would be disproportion that would be arrived

after trial. Further, the attachment has been made absolute. The

Criminal Court after conclusion of trial during judgment would come to a conclusion regarding the disproportion and accordingly

take steps. In view of the same, this Court is not inclined to grant

any relief to the petitioners.

5. Since, the case is of the year 2013, though ten years have

passed, the case is not yet disposed, according to the counsel, this

Court deems it appropriate to direct the Principal Judge for the

trial of SPE & ACB Cases, Hyderabad to dispose off the main case

within a period of six months from the date of receipt of a copy of

this order.

6. With the above direction, this Criminal Petition is disposed

off. Consequently, miscellaneous petitions, if any, shall stand

disposed.
