COMMON JUDGMENT:
None appears on behalf of the petitioners/appellants.
Perused the proceedings dated 09.01.2023. On that day also,
there was no representation on behalf of the petitioners.
However, for a fair play all these Interlocutory Applications
along with the Appeal Suit were directed to be listed today with
a direction that in default of any representation, all these
Interlocutory Applications stands dismissed.
2. I.A.No.1 of 2019 is filed under Section 5 of
Limitation Act to condone the delay of 627 days whereas
I.A.No.2 of 2019 is filed to implead the respondent Nos.2 to 4 in
the Appeal Suit. I.A.No.1 of 2021 is filed to implead the
proposed parties as respondent Nos.5 to 7 in the Appeal Suit
and A.S.No.2 of 2021 is filed for grant of injunction against the
proposed respondent Nos.2 to 7.
3. Therefore, in view of the proceedings dated
09.01.2023, presence or representation on behalf of the
petitioners is felt essential. Since there is no representation,
considering the proceedings dated 09.01.2023, all these Interlocutory Applications along with Appeal Suit are dismissed
for default for non-prosecution.
In the circumstances of the case, there shall be no order
as to the costs. Miscellaneous applications, if any pending in
this Appeal Suit, shall stands closed.
