Citation : 2022 Latest Caselaw 4810 Tel
Judgement Date : 21 September, 2022

Telangana High Court
Secy., School Education Dept., ... vs Shobana Anand, Adilabad Dist. ... on 21 September, 2022
Bench: Abhinand Kumar Shavili, K. Sarath
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI

                                       AND

                HON'BLE SRI JUSTICE K. SARATH

                           W.P.No. 31265 of 2011

ORDER:(Per Hon'ble Sri Justice Abhinand Kumar Shavili)

This Writ Petition is filed aggrieved by the orders of the

A.P. Administrative Tribunal, Hyderabad (for brevity 'the

Tribunal') passed in O.A.No.7876 of 2007 dt.15-04-2010.

        2. Heard the learned Government Pleader for Services-I

appearing for the petitioner.

        3. It has been contended by the petitioner that the 1st

respondent was appointed disqualified for being appointed to the

post of Secondary Grade Teacher/School Assistant on the ground

that she did not possess Telugu as first language and the Tribunal

vide orders dt.22-12-2010 was pleased to allow the O.A. without

appreciating any of the contentions raised by the petitioners.

4. This Court having considered the submissions made

by the learned counsel for the parties is of the considered view AKS,J & SK,J

that the Tribunal has allowed the O.A. in favour of the 1st

respondent by following the orders passed in O.A.No.168 of 2009

and batch dt.20-12-2010 and the Tribunal has also relied upon the

judgment rendered by a Division Bench of this Court reported in

District Selection Committee v. M.Venugopal and others1

wherein the orders of the Tribunal were upheld.

5. Therefore, this Court is of the considered view that

the Tribunal was justified in allowing the O.A in favour of the 1st

respondent by following its earlier orders passed in O.A.No.168

of 2009 and batch dt.20-12-2010. Hence, this Court is not

inclined to interfere with the orders of the Tribunal.

6. Accordingly, the Writ Petition is dismissed. No

costs.

2003 (5) ALD 512 AKS,J & SK,J

7. As a sequel, the miscellaneous petitions pending, if

any, shall stand closed.
