      THE HONOURABLE SRI JUSTICE K.SURENDER

          CRIMINAL PETITION NO.7771 OF 2022

ORDER:

1. This Criminal Petition is filed under Sections 437 and

439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C")

seeking regular bail to the petitioners/A1 & A3 in Crime

No.246 of 2012 on the file of Pet Basheerbad Police Station,

Cyberabad, registered for the offences punishable under

Sections 302, 379 read with 120(b) of Indian Penal Code.

2. Heard learned counsel for the petitioners and learned

Assistant Public Prosecutor for the respondent-State and

perused the record.

3. Learned Counsel for the petitioners submits that the

petitioners are seeking bail on the ground that the

investigation is almost complete and the petitioners were

arrested on the ground of jumping bail. Since the trial is

almost concluded and the petitioners are in jail since April-

2021, these petitioners can be granted the bail subject to

stringent conditions. He also relied upon the Judgment

rendered by the High Court of Madhya Pradesh in Raja @

Ranu v. The State of Madhya Pradesh in CRA.4310-2020,

dt.04.11.2020, wherein though the petitioner had jumped

the bail was granted the relief of bail.

4. The present S.C.28/2014 is of the year 2014 and the

crime is committed in February, 2013. Since the petitioners

had jumped bail, the proceedings could not take place and it

is almost 9 years since the crime was committed.

5. In the said circumstances, I deem it appropriate to

direct the Sessions Court to complete the process of trial,

within two months from the date of receipt of a copy of this

order. It is needless to say that the petitioner is at liberty to

move the application seeking bail there after.

6. Accordingly, the Criminal Petition is disposed off.

Miscellaneous applications, pending if any, shall stand

closed.
