CRIMINAL APPEAL No.871 OF 2008
JUDGMENT:
This Criminal Appeal is filed under Section 378 (2) of Code of
Criminal Procedure, 1973 (for short "Cr.P.C") by the
appellants/complainants seeking to set aside the acquittal judgment
dated 28.02.2008 passed by the learned III Additional Chief
Metropolitan Magistrate at Hyderabad in C.C.No.1290 of 2003 for the
offence punishable under Section 138 of Negotiable Instruments Act.
2. Heard learned Assistant Public Prosecutor. None appears on
behalf of the appellants. Perused the record.
3. As seen from the proceeding sheet the appellants are not
represented on four occasions earlier. Today also i.e. on 15.09.2022
there is no representation on behalf of the appellants. The appeal is
filed questioning the acquittal of the respondent No.1/Accused under
Section 138 of NI Act it is for the appellants/complainants to prosecute
their case diligently. Even after filing of the appeal in the year 2008 as
seen from the proceeding sheet there was never any representation
on behalf of the appellants after the case being admitted, it shows Crl.Appeal No.871 of 2008
that the appellants are not evincing any interest in prosecuting the
appeal diligently.
4. In the said circumstances, the Criminal Appeal is dismissed for
non-prosecution.
As a sequel thereto, miscellaneous applications, if any, pending,
shall stand closed.
