JUDGMENT: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
Heard Mr. P.Madhukar, learned Assistant Government
Pleader for Transport appearing for the appellants. None has
appeared for the respondent.
2. This writ appeal is directed against the order
dated 04.05.2011 passed by the learned Single Judge disposing of
W.P.No.13915 of 2011 filed by the respondent.
3. By the aforesaid order, learned Single Judge directed the
appellants to release the vehicle of the respondent on deposit of
Rs.1,000/- per ton for the extra load of the vehicle and on
furnishing an undertaking that he would produce the vehicle as and
when required.
4. The vehicle was seized on 02.05.2011. At this distant point
of time, we do not find any good reason to reverse the aforesaid
order of the learned Single Judge.

5. Accordingly, the writ appeal is dismissed. No costs.
As a sequel, miscellaneous petitions, pending if any, stand
dismissed.
