     CIVIL MISCELLANEOUS APPEAL NO.961 OF 2008
JUDGMENT:

None appears on behalf of appellant. This civil

miscellaneous appeal is pending since the year 2008 itself.

As per the proceedings dated 26.10.2022 also there was no

representation on behalf of appellant and accordingly, the

Registry was directed to list the matter today under the

caption 'for dismissal'. Hence presence or representation

on behalf of the appellant is felt essential. Therefore,

considering the proceedings dated 26.10.2022, I do not

find any merit to adjourn the matter in the absence of

proper representation. Accordingly, this civil miscellaneous

appeal is dismissed for default for non-prosecution. In the

circumstances of the case, there shall be no order as to the

costs. Miscellaneous applications, if any pending, shall

stands closed.
