JUDGMENT:

When the matter is taken up for hearing on 29.10.2022, there

was no representation for the appellant in the forenoon as well as in

the afternoon, therefore, the matter was ordered to be posted today

under the caption "for dismissal".

Today i.e., 31.10.2022, though the matter is listed under the

caption "for dismissal", there is no representation for the appellant

when the matter is called in the forenoon as well as in the afternoon.

Therefore, this Court is constrained to dismiss the second

appeal for default and for non-prosecution.

Therefore, the second appeal is dismissed for non-prosecution.

There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand

closed.
