JUDGMENT:

When the matter was taken up for hearing on

28.10.2022, there was no representation for the appellant

in the forenoon as well as in the afternoon, therefore, the

matter was ordered to be posted today under the caption

"for dismissal".

Today, i.e., 29.10.2022, though the matter is listed

under the caption "for dismissal", there is no

representation for the appellant when the matter is called

in the forenoon as well as in the afternoon.

Therefore, the second appeal is dismissed for default

and for non-prosecution. No order as to costs.

Pending miscellaneous applications, if any, shall

stand closed.
