               CRIMINAL APPEAL NO.849 OF 2010

J U D G M E N T:

The present Criminal Appeal is filed under Section 378 (4) of

Code of Criminal Procedure, 1973 (for short "Cr.P.C") by the

appellant/complainant aggrieved by the judgment of acquittal

recorded by the I Additional Judicial Magistrate of First Class at

Khammam on 07.12.2009 in STC No.381 of 2008 finding the

Respondent No.1/Accused not guilty for the offence punishable

under Section 138 of Negotiable Instruments Act.

2. Learned counsel for appellant/complainant submits that the

appeal is filed by the appellant who is the complainant in the lower

Court. He also submits that though the appellant filed appeal

against the acquittal of the respondent No.1/Accused, he seeks

permission of this Court to withdraw the criminal appeal for the

reason of the death of the respondent No.1/Accused.

3. In view of the said submission of the learned counsel for the

appellant/complainant permission is accorded.

Crl.Appeal No.849 of 2010

4. Accordingly, the Criminal Appeal is dismissed as withdrawn.

Miscellaneous applications pending, if any, shall stand closed.
