JUDGMENT: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
None appears for the appellants on call.
2. This writ appeal is directed against the order dated
25.04.2006 passed by the learned Single Judge dismissing
W.P.No.35954 of 1997 filed by the appellants as the writ
petitioners.
3. The related writ petition was filed by the appellants
seeking a direction to the respondents to pay market value
of the land admeasuring 4000 square yards in Survey
Nos.13, 14 and 15 of Murad Mahal Village, Charminar
Mandal, Hyderabad.
4. Learned Single Judge noted that ownership of the
appellants in respect of the property in question was
questionable. Land was being developed for the residential
colony. In the circumstances, learned Single Judge held
that question of acquiring the land either by way of private
negotiations or by initiating land acquisition proceedings
would not arise.
5. We do not find any error or infirmity in the view
taken by the learned Single Judge.
6. However, as the appellants are unrepresented, the
writ appeal is dismissed for non-prosecution.
Miscellaneous applications pending, if any, shall
stand closed. However, there shall be no order as to costs.
