WRIT PETITION No.36242 of 2022
ORDER:
Heard learned counsel for the petitioner and the learned
Assistant Government Pleader for Home.
2. Learned counsel for the petitioner submits that suspect sheet
dated 03.11.2021 was opened against the petitioner on the basis of
the three cases as under:
i. Cr.No.16 of 2021 U/s.420, 406 r/w 34 IPC of WCO Team-IX, CCS, DD, Hyderabad. The case is pending trial vide Cc.No.13876 of 2021 before the Hon'ble concerned court.
ii. Cr.No.530 of 2015 U/s. 420 IPC of Afzalgunj Police Station, Hyderabad. The case ended in acquittal on 23.05.2022 vide CC.No.703/2015 before the Hon'ble concerned court.
iii. Cr.No.3467/2016 U/s. 406, 409 IPC of Afzalgunj Police Station, Hyderabad. The case ended in acquittal on 20.11.2021 vide CC.No.1105/2016 before the Hon'ble concerned court.
3. In the counter filed by the respondent No.6, it is admitted
that the cases shown at Sl.Nos.ii and iii ended in acquittal.
Thus, only one case is pending against the petitioner. In view of the
judgment of this Court in UMESH SINGHANIYA v.
THE COMMISSIONER OF POLICE, HYDERABAD1, the
continuance of suspect sheet against the petitioner on the strength
of a solitary case is unsustainable.
Hence, the writ petition is allowed and the respondents are
directed to close the suspect sheet opened against the petitioner.
Pending miscellaneous petitions, if any, shall stand closed.
There shall be no order as to costs.
