CIVIL MISCELLANEOUS APPEAL No.211 OF 2005
JUDGMENT: (Per Hon'ble Dr.SA,J)
This appeal, under Section 47 of the Guardian and
Wards Act, is filed by the appellant/father aggrieved by the
decree and order, dated 10.11.2004, passed in O.P.No.1773
of 2003 by the learned I Additional District Judge, Nizamabad,
whereby, the subject O.P. filed by the appellant/father, under
Section 25 read with 10 of the Guardian and Wards Act,
seeking custody of the minor children, by names Master
Ch. Vaishnav and Master Ch. Vaibhav, was dismissed.
2. Heard. Perused the record.
3. It is brought to the notice of this Court by the learned
counsel for the appellant/father that the minor children, by
names Master Ch. Vaishnav and Master Ch. Vaibhav, have
attained majority and therefore, cause in the appeal does not
survive for adjudication.
4. Taking the said submissions on record, all further
proceedings in this appeal are closed.
5. Accordingly, the appeal is disposed of.
Miscellaneous Petitions, if any, pending in this appeal
shall stand closed. There shall be no order as to costs.
