CRIMINAL APPEAL No.656 OF 2010
JUDGMENT:
1. This Criminal Appeal is filed by the Appellant/Complainant
aggrieved by the acquittal recorded by the XVI Additional Judge-
cum-XX Additional Chief Metropolitan Magistrate, City Criminal
Courts at Hyderabad in C.C.No.634 of 2008 dt.26.08.2009 in
acquitting the accused under Section 138 of the Negotiable
Instruments Act.
2. When the matter is listed on 10.10.2022 there was no
representation on behalf of the appellant, as such, this Court
directed to post the appeal to this date i.e. 12.10.2022, under the
caption 'for dismissal.
3. Even, today, when the matter is listed under the caption 'for
dismissal' there is no representation on behalf of appellant. It
shows that the appellant/complainant is not evincing any
interest in prosecuting the matter diligently. Further, the
offences under Section 138 of the Negotiable Instruments Act, are
quasi criminal in nature and also compoundable offences. Since
the appellant/complainant failed to prosecute his case diligently,
no useful purpose would be served in keeping the appeal
pending.
4. Accordingly, the Criminal Appeal is dismissed for non-
prosecution.
As a sequel thereto, miscellaneous applications, if any, shall
stand closed.
